The British drugmaker AstraZeneca is on course to lose its patent protection for its cholesterol-lowering drug Crestor, which treats people with heart disease and kidney disease, the company announced on Thursday.
The drugmaker will be required to pay up to £3.5 billion to settle some of the lawsuits brought by consumers who say Crestor caused kidney problems in patients with heart disease.
The suit states that Crestor caused a kidney disorder known as a syndrome that can cause kidney failure, which is a medical emergency.
The settlement also includes a £5 million payment of $2.3 billion to the British consumer group the British Heart Foundation and the UK Consumer Health Alliance to settle cases brought by the company against AstraZeneca and its co-promotion partner, Boehringer Ingelheim, for failing to warn about heart problems that Crestor caused.
The agreement was reached as the company is looking to bolster its drug sales through an advertising campaign by GlaxoSmithKline and AstraZeneca, the companies said in a statement.
The company said the settlement is expected to be reached after the company meets in March, and that the British drugmaker is "helping to build upon its existing financials and business relationships with Glaxo and Boehringer Ingelheim."
The announcement was made during a meeting with Pfizer, AstraZeneca and GlaxoSmithKline's chief executive, to discuss the pharmaceutical firm's strategy to bolster sales, and to strengthen the company's marketing efforts.
The settlement is expected to be reached within the next few weeks.
Pfizer said it has agreed to settle the lawsuits related to the company's cholesterol-lowering drug Crestor, but said it expected the settlement to be reached in the first quarter of next year.
The British pharmaceutical firm also said it has reached an agreement with GlaxoSmithKline and the U. S. Department of Health and Human Services that it will appeal the settlement to the Federal Trade Commission, as the company faces competition from generic versions of the drug.
The agreement is not expected to come to an end. The U. Justice Department declined to comment on the settlement.
The company has agreed to pay the government $1.9 billion to resolve the suits, a payment of about $3.5 billion.
Pfizer said it was pleased with the settlement, noting it included a "full-oroughness" clause in the settlement agreement, which was also included in the price of Crestor.
The company has already received a letter from the FDA warning that Crestor is not safe and that Crestor's potential side effects include elevated blood pressure, fatigue, dizziness and low cholesterol.
GlaxoSmithKline said it expects Crestor will continue to market Crestor as a generic alternative and will continue to market the drug as a "bioidentical" version.
The company also said it will pay about $2 billion to resolve the cases and would pay $1.1 billion to resolve all other lawsuits.
The company is also reviewing its plans to launch a drug called Zetia, which is a cholesterol-lowering agent that helps to lower high cholesterol and reduce the risk of heart disease.
